Welcome to RITE! Our Terms of Service outline the rules and regulations for using our app. By accessing and using RITE, you agree to comply with these terms. Please read them carefully.
User Responsibilities
1.1 Account Information:
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any security breaches.
- If you are a therapist or healthcare provider using RITE for professional purposes, you must ensure that all information in your profile is accurate and up to date before accepting any agreements, including the Business Associate Agreement (BAA).
1.2 Use of the App:
- You agree to use the app in accordance with all applicable laws and regulations.
- You must not use the app for unlawful activities, including fraud, harassment, or spamming.
- You must not interfere with or disrupt the integrity or performance of the app.
1.3 Interaction Logging & Assessments:
- You are responsible for the accuracy and completeness of the data you enter.
- You must not enter false, misleading, or defamatory information.
- Assessments and quizzes are for informational purposes and are not professional healthcare advice.
- Interaction and/or assessment data may be used for personal insights, therapy assistance, AI model training, and psychological research. If used for research, it will be anonymized.
Account Security
2.1 Password Protection:
- Choose a strong password and update it regularly.
- Do not share your password with others.
2.2 Security Measures:
- We employ industry-standard encryption methods to protect your data. However, you acknowledge that no system is 100% secure.
- RITE follows HIPAA-compliant security standards for protected health information (PHI) stored or processed through the platform.
Prohibited Activities
3.1 Misuse of the App:
- You must not attempt to gain unauthorized access to any part of the app or related systems.
- You must not use the app to distribute viruses or other harmful software.
3.2 Content Restrictions:
- You must not upload content that is illegal, harmful, abusive, or infringing on the rights of others.
3.3 Commercial Use:
- The app is intended for personal use only. Commercial use requires prior written permission.
AI-Generated Insights Disclaimer
- RITE may use AI-generated insights to provide personalized recommendations. These insights are not a substitute for professional relationship advice, therapy, or psychological counseling.
- Users acknowledge that RITE is not responsible for decisions made based on AI-generated suggestions.
Data Storage, Retention & Deletion
5.1 Data Retention & Anonymization:
- If you delete your account, all personally identifiable data will be deleted within 7 days.
- If your data is being used for research purposes, it will be anonymized and deleted at the end of the study.
- PHI will be anonymized before deletion if it has been used for research purposes.
5.2 Partial Data Deletion:
- You can delete specific interaction logs at any time.
- Assessment results cannot be individually deleted unless the account is deleted.
5.3 Therapist Data Storage:
- Data shared with a therapist will be stored as long as the account remains active.
- Therapists cannot request deletion of PHI that has already been shared with users.
Third-Party Data Sharing & Analytics
6.1 Third-Party Analytics:
- RITE may use third-party analytics services to improve app performance. No personally identifiable data is sold.
6.2 Marketing & Advertising:
- RITE may use user data for email marketing and targeted advertising. Users can opt out at any time.
6.3 Legal & Research Use:
- Data used for research will be anonymized and retained until the end of the study, after which it will be deleted.
- If required by law, we may disclose data to comply with legal obligations.
HIPAA Compliance & Business Associate Agreements (BAA)
7.1 HIPAA Compliance
- RITE is not a healthcare provider, but if therapists use RITE as part of their treatment plans, the platform may handle Protected Health Information (PHI) under HIPAA regulations.
7.2 HIPAA Business Associate Agreements
- Business Associate Agreements (BAAs): Therapists using RITE for professional purposes must sign a Business Associate Agreement (BAA) with RITE before accessing any features that involve PHI.
- By agreeing to these Terms of Service, therapists acknowledge that they must accept and agree to a separate BAA before using RITE for professional purposes.
- Therapists are responsible for ensuring their own HIPAA compliance. RITE implements industry-standard security measures to protect PHI but does not assume liability for therapists’ HIPAA violations.
7.3 Data Breaches
- Breach Notification: In the event of an unauthorized PHI disclosure, RITE will notify affected users and regulators within 72 hours in accordance with HIPAA’s Breach Notification Rule.
7.4 Cross-Border Consent
- Users consent to cross-border data transfers of PHI for processing and storage on HIPAA-compliant Amazon Web Services (AWS) infrastructure.
Security Breach Notification
- In case of a high-risk data breach, affected users will be notified within 72 hours.
- Lower-risk security incidents will be reported within 7 days.
International Compliance (GDPR & CCPA)
- GDPR (EU Users): Users have the right to access, correct, delete, or restrict processing of their data.
- CCPA (California Users): Users can request data access, deletion, and opt-out of data sharing.

Cross-Border Data Storage
- RITE uses Amazon Web Services (AWS) servers, which may operate in multiple locations.
- By using RITE, users consent to cross-border data transfers.
App Usage by Minors
- Users under 13 are not allowed to use RITE. Any underage accounts will be deleted immediately.
- Users aged 13–17 may use RITE only with parental or guardian consent.
Arbitration & Legal Disputes
11.1 Arbitration
- Binding Arbitration: Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
- Waiver of Jury Trial: Users waive their right to a jury trial or class-action lawsuit.
- Governing Law: These terms are governed by the laws of Salt Lake City, Utah, without regard to conflict of laws principles.
11.2 Disputes
- HIPAA-Related Disputes: Any disputes regarding HIPAA compliance, PHI handling, or data breaches must also follow binding arbitration as outlined above.
Force Majeure Clause
- RITE shall not be held liable for service disruptions due to unforeseen events, including natural disasters, cyberattacks, government restrictions, or server failures.
Modifications to the Terms
- We may update these Terms of Service. Continued use of the app constitutes acceptance of the revised terms.’
Termination of Service
- You may delete your account at any time, and your data will be deleted within 7 days.
- We reserve the right to suspend or terminate your account if you violate these Terms.
